The difference
Very few defense lawyers have been inside the lab.
Brennon Mitchell completed the American Chemical Society's forensic
chromatography program and holds the ACS-CHAL Forensic Lawyer-Scientist designation,
earned by a small number of attorneys nationwide.
That is not a plaque. It is hands on training with the same instrumentation crime labs
use to convict Texans, which means the chromatograms, calibration curves, and quality
control records in your file get read by your lawyer instead of forwarded to an expert

Why any of this matters to you
Juries hear a number and treat it as a fact of nature. It is not. It is the output of
an instrument that was calibrated by a person, loaded by a person, and interpreted by a
person, in a lab with a workload and a backlog.
None of that means the result is wrong. It means the result is checkable, and almost
nobody checks. I request the raw data on every case where the State's evidence came out
of a machine, in DWI files and in drug cases both.
Sometimes the data confirms what the report says and I tell my client so. Honesty
about that is part of why the ones I do fight are worth fighting.
Every entry lists the charge, the court, and the date, so it can be checked
against the district clerk's records. Results depend on the facts of each case.

Tell me what happened
All of it, including the parts you would rather leave out. I cannot defend a version of
events that falls apart when the video comes in. This office is not a place where you get
judged, and what you tell me is privileged from the first phone call.
STEP 02
Understand what you are actually facing
Not the worst case you read online at two in the morning. The realistic range, the likely
timeline, what the county you are in tends to do with cases like yours, and where the
pressure points are.
STEP 03
Build the file
Discovery requests, video, the lab package if there is one, witnesses, and any expert the
case needs. This is the slow part and it is where cases are won, long before
anybody walks into a courtroom.
STEP 04
Resolve it or try it
Most cases settle. The ones that settle well settle because the State knows the file is
ready for a jury. You decide, with real information in front of you. I will give you my
recommendation and I will tell you plainly when I disagree with your choice.
