Where these cases come from
Lake Conroe is one of the most heavily patrolled bodies of water in Texas, particularly over Memorial Day, the Fourth of July, and Labor Day weekends. Texas Parks and Wildlife game wardens, the Montgomery County Sheriff's marine unit, and multi-agency Operation Dry Water details all work the lake.
A game warden does not need reasonable suspicion to stop your boat. Texas law allows water safety checks without any indication that you have done something wrong. That is a real difference from a traffic stop and it removes one of the most common defenses in a DWI case before it starts.
What it does not remove is everything that comes after the stop.
Field sobriety testing does not work well on a boat
The standardized field sobriety tests assume a flat, dry, stable surface. A dock is not that. A deck is definitely not that. Officers know this, which is why marine officers are supposed to use seated battery tests designed for the water: the finger to nose, the palm pat, the hand coordination test, and others.
Two things get checked. Whether the officer used the right battery, and whether they accounted for what the National Association of State Boating Law Administrators calls boater fatigue. Sun, wind, engine vibration, dehydration, and glare over several hours produce a person who looks impaired and is not. That is not a courtroom trick. It is in the training materials.
Penalties and what carries over
A first BWI is a Class B misdemeanor: up to 180 days in county jail, a fine up to $2,000, and a minimum jail term on conviction. If a child under fifteen was on board, the charge becomes a state jail felony.
The part people miss is the crossover. A BWI conviction counts as a prior for a later DWI, which means a first DWI five years from now gets charged as a second. A BWI also does not automatically suspend your driver license, but a refusal of a specimen can trigger an ALR suspension, so the same fifteen day deadline can apply.
Blood and breath evidence in a BWI case gets analyzed the same way it does in a DWI case, which means the same chromatography questions apply. That is the part of this work I am trained for.

Can a game warden stop my boat for no reason?
Yes. Texas allows water safety inspections without reasonable suspicion. That makes the stop itself hard to attack, so the defense usually lives in what happened after.
Does a BWI suspend my driver license?
Not automatically on the boating charge itself. If you refused a breath or blood specimen, an ALR suspension can still follow, and the fifteen day request deadline applies. Call before that window closes.
Is BWI a prior for DWI?
Yes. Texas counts a prior BWI conviction when enhancing a later DWI. That is the single biggest reason not to just plead it out to make it go away.
